ACTIONMAP INC. PRIVACY POLICY
INTRODUCTION
This Privacy Policy (“Policy”) describes how we protect our users’ privacy through controlling the use of the Personal Data (defined below) that our users provide to us. This includes:
■ the Personal Data we collect,
■ how that information may be used,
■ with whom it may be shared, and
■ your choices about how to control that information.

WHO WE ARE / WHAT WE DO / HOW TO CONTACT US
ActionMap, Inc., is a California corporation (“ActionMap”, “us”, “we”, “our”).
ActionMap Inc. operates a collection of online software functions that we call our Online Services. These consist of our websites (“Websites”), the ActionMap® Toolkit™ software application (“Software”) and other online products that we may offer, and other online services that support our business operations (“Supporting Services”), such as for billing, email communications, customer support and customer relationship management. This Privacy Policy applies to your use of any of our Online Services.

DEFINITION OF PERSONAL DATA
“Personal Data” means information about you that can be used to specifically identify you, including for example your name, email address, telephone number, mailing address and financial information such as your payment method (credit card number, expiration date or other financial information).
We will only collect, process and disclose Personal Data in accordance with this Policy, or in accordance with laws applicable to the collection, use and disclosure of Personal Data.
In all cases within the current scope of this Privacy Policy, the Personal Data of yours that we collect, process and share is either a) directly provided by you or b) gathered from publicly available sources, such as LinkedIn.
NON-PERSONAL DATA (Overview)
“Non-Personal Data” is information that is not personally identifiable to you and that we collect automatically or through your input when you access our Online Services. Examples of Non-Personal Data are the type of browser you are using or non-personal statistical data. Non-Personal Data is described in more detail later in this document. YOUR CHOICES WITH RESPECT TO YOUR PERSONAL DATA
You may withdraw consent at any time
This applies to our use of your Personal Data for consulting services and software marketing communications. For this information you have the right to withdraw consent at any time by using the unsubscribe links provided in the footer of our Website (www.actionmap.org; below if you are at the website) or in our emails or by writing to support@actionmap.org.
You may access your data at any time
You have the right to access any Personal Data of yours that we process. Please note that at present all such Personal Data is either provided directly to us by you or is publicly available. Also, except for information we collect in business conversations with your related to our services, all such Personal Data is viewable through user-available interfaces in our Online Services or through links in emails that we send to you. To access Personal Data associated with Software subscriptions please see the procedures at the ActionMap Help Desk Site at actionmap.zendesk.com. To change Personal Data for non-online service emails please see the links at the bottom of the emails we send you. If you feel that is not sufficient knowledge of the Personal Data we have for you, please contact us with an explicit request for access at support@actionmap.org. Please note that requests that we feel are excessive may result in cancellation of our services to you.
You may correct any errors in the Personal Data we have for you
You have the right to change certain Personal Data related to your use of our Online Services (such as your name and billing information). As in the paragraph above most of that information is accessible to you. To change Personal Data associated with Software subscriptions please see the procedures at the ActionMap Help Desk Site at actionmap.zendesk.com. To change Personal Data for non-online service emails please see the links at the bottom of the emails we send you. If you need further assistance in correcting Personal Data that we have for you please send a request to support@actionmap.org.
Please note an important point about your right to change your email address: in the current release of the software, to change your primary contact email address you must cancel any Software subscriptions and unsubscribe from our mailing lists and then resubscribe to both. More detail on this can be viewed by clicking here.
You may have all your Personal Data deleted
You have the right to have all of your Personal Data removed from our documents and systems. In all cases within the scope of this Privacy Policy your Personal Data will be removed via our data retention policies when you withdraw consent (as described above) and/or cancel any Software subscriptions. If you would like further action to delete your information, please contact us with a request at support@actionmap.org.
You may object to processing of your Personal Data
You have the right to object to any type of processing of Personal Data that we may perform under the purposes described above. However, our only effective actions to modify how we process your Personal Data will be to cancel any Software subscriptions you have and/or remove you from our mailing lists. You may initiate those actions yourself via the Software subscription communications we provide or the unsubscribe links we provide. Alternatively, you can contact us with a request at support@actionmap.org.
You may lodge a complaint about our handling of your Personal Data with a supervisory authority
You have the right to lodge complaints with a supervisory authority about our performance with respect to this Privacy Policy. You may do this in the country or state of your primary residence.
You may have your Personal Data sent to you
In certain regulatory frameworks, such as if you a citizen of an EU country, you have the right to receive the Personal Data that we have for you in a commonly-used machine readable format. However, since all such data is either supplied by you to us directly or is available from publicly available sources, we may ask for an explanation of your need. Based on that explanation we may choose to a) charge you a small fee for supplying the data and/or
b) cancel your Subscriptions and delete you from our mailing lists after supplying you with the data.
TRANSFERS TO THIRD COUNTRIES AND SAFEGUARDS
Your data may be transferred to third countries via our Supporting Services as a part of normal cloud-based computing. The safeguards for such transfers are that our Supporting Services are internationally recognized services that have made public commitments to maintain regulatory approval of such transfers.
AUTOMATED DECISION MAKING, INCLUDING PROFILING
Within the scope of this Privacy Policy your Personal Data is not used by us for any automated decision making or profiling.
BILLING CONSENT
By registering for a subscription to our Software and providing your payment information, including but not limited to credit card details, the information you provide will be used by one of our Supporting Services (our Billing Service, currently FastSpring) to bill you for the use of the Software. By providing your payment information details in this manner, you consent to and authorize our Billing Service to provide your payment information to payment processors and financial institutions as necessary to process your payment.
LEGALLY REQUIRED DISCLOSURE
We may disclose your Personal Data as permitted or required by applicable law. For example, we may be compelled to release information by a court of law or other person or entity with jurisdiction to compel production of such information. If we have reasonable grounds to believe information could be useful in the investigation of improper or unlawful activity, we may disclose information to law enforcement agencies or other appropriate investigative bodies.
THIRD PARTY LINKS
Our Online Services may contain links to other Internet sites and resources (“Third Party Links”). ActionMap is not responsible for and has no liability for your use of Third-Party Links or the content thereof. By using Third-Party Links, you acknowledge and agree that ActionMap is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such materials at Third-Party Links. ActionMap does not warrant or endorse and does not assume and will not have any liability or responsibility to you or any other person for any Third-Party Links or for any other materials, products, or services of third parties. ActionMap is not responsible for the contents of, updates to, or privacy practices of third parties operating Third-Party Links. The Personal Data you choose to give to such third parties is not covered by ActionMap’s Privacy Policy. You agree that you use Third-Party Links at your sole risk. We highly recommend you review and familiarize yourself with the terms of use and privacy policies of all Third-Party Links prior to using them.
CALIFORNIA “DO NOT TRACK” DISCLOSURE
ActionMap Inc. does not track its users over time and across third party websites to provide targeted advertising and as such our Websites and Software do not respond to Do Not Track signals.
SECURITY OF PERSONAL DATA
The security of your Personal Data is important to us. We maintain safeguards to protect your Personal Data from unauthorized access, disclosure, or misuse, such as using SSL encryption. However, no system can be completely secure. While we take meaningful steps to secure your information, we do not promise, and you should not expect, that your Personal Data will always remain secure.
CHILRENS’ PRIVACY
Submitting contact information to and use of our Online Services is restricted to individuals over the age of 18. We do not knowingly collect Personal Data from children under the age of 13.
AMENDMENTS TO THIS PRIVACY POLICY
From time to time we may amend this document and publish the latest version on our website at actionmap.org. You should periodically review this document to ensure that you are satisfied with any changes we have made. We may also send emails to users of our Online Services to notify them of such changes.

Legal Basis for Processing and Consequences if Processing Is Not Performed
For general purpose #1, providing Software subscriptions, our legal basis for processing your Personal Data is to support your subscription to the software. If you do not provide your Personal Data for this purpose, we cannot provide you a subscription to the Software.
For general purposes #2 and #3, providing you high quality Online Services and contacting you about additional services, our legal basis for processing your Personal Data is your explicit consent to use your data for that purpose. That consent is given at the point that you provide the Personal Data. That consent is optional. However, if you do not provide your Personal Data for that purpose it may affect our ability to contact you for consulting services and/or the quality of your experience at our Websites.
Non-Personal Data – More Detail
We may also automatically collect Non-Personal Data from you when you visit our Online Services. This information includes your IP address, browser type, language, location data, and access times. Non-Personal Data is collected through various tracking technologies, which may include “cookies,” “web bugs” or “web beacons,” and “mobile device identifiers.”
Cookies are bits of data stored on your device through your browser or mobile application that allows the browser or mobile application to remember you the next time you visit. Cookies enable smoother, more efficient use of the Online Services by storing your specific information and preferences such as theme, language setting, privacy preferences, and even user ID and password, so you do not need to reenter those each time you visit our Online Services. Cookies do not link to or store your Personal Data.
If cookies at our Online Services are optional (for example, for tracking your page navigation within a website) you will be given the option to decline their use. However, doing so may affect your use of the Online Services. Certain cookies, including those that support your access to our Online Services (for example, for “remember my login” features), are required by us for the delivery of those services. If you wish to avoid their use you must cancel your use of the associated Online Services.
In addition, we may also utilize Google Analytics or similar analytics tools in the collection, compilation and analysis of information about the use of our Online Services.
Note Regarding Limitations on How to Change Your Email Address in the Current Software Release
In this section the term “Subscription Email Account” refers to the email address and email account that you provide to us for subscription registration, billing and access to the Software.
In the current release of the Software, the only way to change your Subscription Email Account is to cancel your subscription to the Software, unsubscribe from the mailing lists and then re-subscribe to either or both.
We apologize for this inconvenience. However this functionality exists as part of our commitment to the protection of your Personal Data privacy and to the security of your User Content (“User Content “; as defined in our Terms of Service; in general this means the Non-Personal Data that you directly enter into our Software as part of the primary Software functionality).
Because of the above functionality, maintaining continued access to your Subscription Email Account is critical to the use of our Online Services. Losing access to your Subscription Email Account will eventually result in loss of access your Software subscription and deletion of all your data, because you will no longer be able to change your password, receive billing notices or authenticate yourself with our support team.
If you lose access to your Subscription Email Account and you should immediately take the following steps:
1) If still have the email address and subscription password for your Subscription, you should login to the Software and download all your User Session Content (“User Session Content”, defined in our Terms of Service) from the Software as soon as possible.
For paid accounts:
2a) You should then dispute the most recent subscription bank charge with your bank, at which point our subscription billing service will cancel your subscription for billing purposes. That in turn will cause a cancellation of your subscription in the Software.
For non-paid accounts:
2b) You should notify us at support@actionmap.org. We will attempt to contact you via email, and if unsuccessful, after a period of time we will suspend your subscription. After another period of time if we have observed no account activity we will cancel your subscription.
Please be aware that if your subscription has been cancelled in the Software, you will lose access to your User Content and particularly your User Session Content. For this reason, we recommend that you download your User Session Content after each use of the Software, and in all cases before disputing a billing charge with your bank.
With your User Session Content downloaded, you can open a new subscription with a new email address and upload and access any User Session Content that you wish to continue working with.
